Terms of Service

Welcome to Fortunia. These Terms of Service ("Terms") govern your access to and use of Fortunia (the "Game"), operated by Dragonfish Entertainment LLC, doing business as DRGNFSH ("we," "us," "our," or "DRGNFSH"). By creating an account, making a purchase, or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.

1. Plain-Language Summary

This is the short version. The full terms below control if there is ever a conflict, but here is the spirit of the agreement:

Your account and progress are yours. We store your local stats and profile data securely so you can play across devices.
Purchases are non-subscription, one-time unlocks. You buy game features once (e.g., Full Game Access, Custom/Pass-and-Play, or AI Opponents), and they remain unlocked for your account.
Don't exploit or reverse-engineer the Game. Botting, hacking, altering client state, or attempting to exploit in-game mechanics degrades the experience for everyone and will get your account terminated.
We protect our IP. Fortunia, the artwork, domino assets, rule engines, and characters like TUNA and Lady For belong strictly to DRGNFSH.
Play responsibly and respectfully.

2. Who Can Use the Game

Age Requirements

You must be at least 13 years old (or the legal minimum age in your jurisdiction) to create an account or play Fortunia. Players under 18 must have permission from a parent or legal guardian.

Account Eligibility

You may not use the Game if you are:

Located in a sanctioned jurisdiction or restricted territory.
Previously suspended or banned from DRGNFSH games or services.

Account Responsibility

You are responsible for maintaining the confidentiality of your login credentials (managed via Clerk) and for all activity occurring under your account. You agree to notify us immediately of any unauthorized access.

3. Purchases, Payments, and Digital Unlocks

In-App Purchases

Fortunia offers individual, one-time digital unlocks (such as Fortunia the GAME, Fortunia Custom/Pass-and-Play Unlock, and Lady For Expert AI Unlock). Prices are displayed in-game and on checkout screens.

Payment Processing

Payments are processed securely via Stripe or authorized app store platform providers (e.g., Apple App Store, Google Play Store). DRGNFSH does not receive or store your full credit card details.

Refunds

All purchases of digital unlocks are final and non-refundable except where required by applicable law or the explicit refund policies of the app store platform through which the purchase was made.

4. Player Data & Save States

Local and Cloud Progress: Fortunia tracks game statistics (such as games played, win/loss ratios, Gold Pips, and condition history). Profile credentials and entitlements are synchronized via Clerk.

Data Resets: You may reset your local lifetime stats at any time within the Game's Settings menu. DRGNFSH is not responsible for restoring stats manually reset by the player.

5. Acceptable Use Policy

You agree NOT to:

Cheating & Exploitation: Modify client code, inject memory hacks, use automated bots/scripts, or exploit bugs to manipulate match outcomes or unlock content without purchase.

Reverse Engineering: Decompile, reverse engineer, disassemble, or extract source code, game logic, domino assets, or artwork from Fortunia.

Account Abuse: Share, sell, or transfer your account to third parties, or attempt to bypass paywalls and entitlement checks.

Interference: Disruption of underlying game services, API callbacks, or server infrastructure.

Enforcement

Violations may result in warnings, stat wipes, feature suspensions, or permanent account termination without refund.

6. Intellectual Property of the Game

DRGNFSH retains all right, title, and interest in and to:

The Fortunia name, logo, game design, rule mechanics, and visual identity.
All original artwork, domino textures, audio tracks, sound effects, and UI layouts.
Characters, names, and profiles including TUNA, Lady For, and Dragonfish Entertainment.

You may not copy, reproduce, distribute, or create derivative works from any part of the Game without prior written authorization from DRGNFSH.

7. Service Availability & Updates

We reserve the right to update, patch, modify, or temporarily suspend the Game for maintenance, bug fixes, or feature improvements. While we strive to maintain high availability, we do not guarantee uninterrupted access to online services or backend authentication nodes.

8. Disclaimers and Limitation of Liability

AS IS Basis: FORTUNIA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRGNFSH'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE GAME IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER. DRGNFSH IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

9. Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Any legal action or dispute arising from these Terms shall be resolved in the state or federal courts located in Douglas County, Georgia.
